Property Division

In North Carolina, all “marital property” and “divisible property” is subject to the Court’s authority to make an “equitable distribution” of property between the parties.

In many divorce cases, it can be a challenge to figure out how to divide the assets and debts accumulated over the course of the marriage.

Although the law in North Carolina presumes that the 50/50 division of marital and divisible property and debt is “equitable” and fair, there are multiple factors for the parties and Court to consider.

Every property division case is different.
